1) What is it?

A European Product Placement Declaration is a required legal delivery document used to comply with the European Audiovisual Media Services Directive (2007/65/EC). This directive mandates that all media service providers disclose whether a program received production aid or includes product placement of material value. The declaration confirms, under representation and warranty, whether the film or series includes any such paid or guaranteed brand integrations or has benefited from significant production support.

2) Who is this for?

 Producers and Licensors finalizing delivery for distribution in the EU.

 Sales Agents, Distributors, and Broadcasters responsible for regulatory compliance.

 Business Affairs and Legal Delivery Teams ensuring accurate disclosure of promotional or financial brand participation.

 Compliance Officers and E&O Insurers verifying that all advertising, sponsorship, and brand-integration obligations meet EU transparency standards.

3) What does it include?

The form documents the program’s title, production company, and date, then requires the producer to answer two key disclosure questions:

1.     Production Aid of Substantial Value

o   Confirms whether goods, services, or any production contributions exceeding 1% of the total budget and €1,000 in value were provided by third parties.

o   “Substantial Value” refers to any single supporter or group of supporters contributing goods or services meeting both thresholds.

o   Response options: Yes / No / Inquiry Unsuccessful.

 

2.    Product Placement for Value or Consideration

o   Declares whether any brand, service, or trademark was visibly included or referenced in exchange for payment or other consideration, including goods or services of significant value (again defined as over 1% of the budget and €1,000 minimum).

o   Response options: Yes / No / Inquiry Unsuccessful.

Finally, the declaration includes signature lines for date, authorized signatory, printed name, and company, serving as a sworn certification of accuracy under the directive.
